Practice Areas -> Litigation -> Commercial Litigation

Commercial litigation involves resolving business disputes through the legal system, primarily handled by the Commercial Court, a division of the High Court. This court specialises in complex cases such as contract disputes, corporate issues, insolvency, and intellectual property conflicts. The process emphasises efficiency with active case management, strict timelines, and encouragement of alternative dispute resolution (ADR) methods like mediation and arbitration. Typically, the losing party covers legal costs. The goal is to provide a streamlined, expert-driven resolution to commercial conflicts. Proceedings dealt with by the Commercial  Court must have a commercial dimension and generally must have a value of not less than €1m.
